FTP & Chill Apparel – Terms of Service (Australia)
Effective date: 3 August 2025
1. Agreement to Terms
By accessing https://www.ftpandchill.com (the “Site”) or purchasing any FTP & Chill Apparel product (the “Services”), you (“you”, “your”) agree to be bound by these Terms of Service (“Terms”). If you do not accept these Terms, you must not use the Site.
2. Eligibility & Accounts
2.1 Age. You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order.
2.2 Account Security. You are responsible for all activity that occurs under your login credentials and must keep your password confidential.
3. Orders & Contract Formation
3.1 Offer & Acceptance. Your order is an offer to buy. We accept when we send a written order‑confirmation email.
3.2 Right to Refuse / Cancel. We may refuse or cancel an order (and refund any payment) for suspected fraud, stock unavailability or pricing error.
3.3 Production‑to‑Order. Most items are manufactured on demand; please review estimated fulfilment times before checkout.
4. Pricing, Taxes & Payment
4.1 Currency. Prices are stated in Australian dollars (AUD) and include Goods & Services Tax (GST) unless indicated otherwise.
4.2 Payment Methods. We accept Visa, Mastercard, American Express and PayPal. Full payment is captured at checkout.
4.3 Pricing Errors. If we discover a pricing error after acceptance, we will contact you for instructions or cancel and refund.
5. Shipping & Delivery
Delivery times are estimates only. Risk of loss passes to you upon our hand‑off to the carrier. Title passes on full payment.
6. Consumer Guarantees & Warranties
Nothing in these Terms limits your rights under the Competition and Consumer Act 2010 (Cth) or any non‑excludable consumer guarantees. For details, see our Returns & Refunds Policy.
7. Intellectual Property
All content on the Site—designs, graphics, logos, slogans, product mock‑ups and software—is owned by FTP & Chill Apparel or its licensors. You may not reproduce, modify, distribute or exploit any content without prior written permission.
8. User‑Generated Content & Social Media
By tagging @ftpandchill or #ftpandchill on social media or submitting content to us, you grant us a worldwide, royalty‑free, perpetual licence to repost, display and use that content in our marketing. You confirm you have the necessary rights to grant this licence.
9. Prohibited Conduct
You must not:
- Use the Site for any unlawful purpose;
- Transmit viruses or malicious code;
- Mine data or scrape content without permission;
- Infringe the intellectual‑property rights of others.
10. Limitation of Liability
To the maximum extent permitted by law:
- FTP & Chill Apparel is not liable for any indirect or consequential loss arising out of your use of the Site or Services;
- Our total aggregate liability is limited to the greater of (a) AUD 100 or (b) the amount you paid for the relevant order. Nothing in this clause limits liability for death, personal injury or fraud, or for any right that cannot be excluded under the ACL.
11. Indemnity
You agree to indemnify and hold FTP & Chill Apparel, its directors, employees and agents harmless from any claim arising out of your breach of these Terms or misuse of the Site.
12. Termination
We may suspend or terminate your account or access to the Site at any time without notice if we reasonably believe you have breached these Terms.
13. Third‑Party Links
The Site may contain links to external websites. We are not responsible for the content or privacy practices of those sites.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You submit to the non‑exclusive jurisdiction of the courts of Victoria.
15. Changes to Terms
We may update these Terms by posting the revised version on the Site. Changes apply from the date of posting. Your continued use of the Site constitutes acceptance.
16. Severability
If any provision of these Terms is held invalid, the remaining provisions remain in full force.
17. Entire Agreement
These Terms, together with our Privacy Policy and Returns & Refunds Policy, constitute the entire agreement between you and FTP & Chill Apparel.
